General Terms and Conditions
1 Handling PermittanceRadioactive reagents may only be supplied to companies or persons possessing a handling permittance (Radiation Protection Act of June 30, 1989).2 OrdersThe customer acknowledges our General Terms and Conditions by placing an order.Any deviant agreements require our written confirmation. Delivery cantract becomes valid with our order confir-mation.3 PricesPrices do not include freight charges. All prices are subject to change without prior notice. Invoices are issued at prices valid for the day on which delivery is executed.4 DeliveryAll deliveries are being effected at the buyer's risk. DRG does not take on any responsibility for damages and its consequences and refuse any compensations.We are exempt from any delivery obligations in cases of circumstances, which to sort is beyond our control and which make it impossible or inacceptable for us to execute delivery. In case of any justified complaints being faultless replacement or by creditin the amount. Further claims, especially entitlements to compensation due to non-delivery or late delivery as well as for any other real or legal reason are (so far as permissible in law) rejected.5 PaymentOur invoices are to be paid by prepayment less 2 % cash discount or at 30 days net. For default of payment we charge 2% interest (exceeding the official discount rate). Payment is not valid until we have the total amount at our disposal. Non-observance of our payment conditions entitles us to cease delivery. |
6 Reservation of proprietary rightsWe keep the ownership of the goods delivered until payment is concluded. Preventive transference and preventive sale or mortgage of goods being reserved as our property is inadmissible. The reservation of our proprietary rights is not affected by claims, taken on a current invoice by rehabilitating and accepting the balance.7 ComplaintsThe customer has to charge complaints in written form within one week after receipt of goods.The time we receivethe complaint is decisive. Faulty goods are to be returned at our disposal, strictly subject to our declaration of consent in written form. 8 Place where the contract is to be fulfilledMarburg, Germany9 Court of JurisdictionCourt of jurisdiction, also in case of bills of exchange orcheque transactions is Marburg, Germany. 10 Commitments and ConditionsBy placing an order the customer accepts the preceding terms of sale. Divergent conditions or verbal arrangements are not definite unless we acknowledge them in written form. Possible legal inoperativeness of any part of these General Terms and Conditions have no influence on their further content's legal force. |
